In the morning I was moving into a lovely 800 sq. ft two bedroom apartment in Queens, by the afternoon I was homeless, sobbing on a friends couch surrounded by all my belongings.
This is New York.
I woke up in the morning excited, packed and ready to go.
Rent, broker and deposit paid. Lease signed. Couch ordered. Friends coming over to help unpack. Electric and internet bills in my name ready to rock for the first of the month.
My moving company, Simplify Storage was on the way when I received a phone call from the real estate agent saying, “Postpone your moving truck. We cannot find the tenants, they have disappeared and are not answering their phones. They have not handed over the keys to the apartment.”
I said, “Why don’t you call the police and get rid of their stuff? Their lease is over, how can they do that?”
He said, “Sarah if me or the landlord set foot into that apartment without their permission WE will be the ones who are arrested.”
New York laws favor tenants. Apparently even if the occupants are not paying rent and trashing the apartment they cannot be evicted until the matter has gone to court which can take up to a year.
This is the reason why landlords need to see everything including the tax stubs from the lemonade stand you had when you were 12 years old.
They need to make sure you can pay to protect themselves from this kind of situation, which despite all those precautions is apparently is quite common here.
The moving team at Simplify Storage were kind, flexible and understanding. They canceled the truck and told me to just let them know when I was ready. This at least made the physical moving aspect of this situation a lot easier.
This was the second apartment we lost in a two and a half week period. The first apartment we spent three months renting a bedroom from one of my best friends waiting on it to become available. It was supposed to be an easy situation because we were renting from friends.
When it was time to move, we found out that we didn’t meet the buildings requirements (credit check) and had to let it go. While they were happy to rent it to us, the condo board would not have approved us. Getting an apartment in New York, especially as an immigrant with no credit history, is no easy task. The loss of this first apartment shook me to my core.
By the time this situation happened I was tired, broken and afraid and for the first time seriously considered going back home. After two days of panic attacks, anxiety, tears and homelessness I was finally able to secure an apartment, with all my money from the previous place fully refunded.
My friend’s landlord had a unit in a building up the street available and she knew me from the previous months I had spent renting a room there.
